The AI Talent War Just Moved Inside the Lab
The U.S. government issued a directive requiring Anthropic to block all foreign nationals — including its own foreign-national employees — from accessing its Fable 5 and Mythos 5 models, citing national security concerns. The order does not just regulate who can use an AI model. It defines who can work on one.
Business Insider reporters Tracy Connor and Lakshmi Varanasi published the story on June 13, 2026. Anthropic disputes the basis: the company says it reviewed the reported vulnerability and found only minor, previously known issues. The government issued the order anyway.
Software export controls were tried before. In the 1990s, the U.S. government classified encryption algorithms as munitions. The effort failed — mathematics does not stop at customs. The current directive applies the same logic to frontier AI models, with the same structural tension.
What is new here is the workforce dimension. H-1B visa holders, foreign students on OPT status, and foreign-national permanent residents make up a significant share of the technical and research workforce at every major American AI laboratory. Under the terms of the directive, these employees cannot access the very models their labor helped build. The ‘deemed export’ doctrine means this is a workforce restriction applied inside the lab.
Matthew Pines warned that export control laws operate under strict liability. Peter Harrell objected to vague, nonpublic security claims. Alan Rozenshtein raised the possibility that this becomes the first major First Amendment AI case.
This directive is the first clear instance of the executive branch asserting that a deployed model can be recalled and restricted on national security grounds, without public disclosure of the specific vulnerability, without independent verification, and faster than any legal challenge can run.
